These conditions are the terms and conditions with which you (the User) and Círculo Textil Servicios Textiles SL (hereinafter Textilfy) regulate the use and enjoyment of the Textilfy website. Being a user of the Textilfy website implies that you acknowledge that you have read and accepted these conditions and what derives from the applicable legal regulations in this matter. If you do not agree with these conditions, please do not continue to use the Textilfy website.

1. PURPOSE OF THE WEBSITE.

The Textilfy website has been created for information and commercial purposes for its users, who have information that is offered free of charge and accessible to all registered users without the need to pay any amount at any time of access. It is especially in this environment that Textilfy wishes to establish these conditions and limitations of use, which is extended and added in all complementary and non-contradictory clauses to those that may cover other parts of the website subject to general and/or particular conditions and even “Particular Conditions” in the event that it is necessary for specific services. These last “Specific Conditions” must be made available to the User in a reliable manner by any means and specifically endorsed by the User, before both parties consider them accepted and act accordingly.

2. LIMITATIONS ON THE USE AND PROTECTION OF THE INFORMATION AND CONTENTS OF ESTAMPABLE.

The content and information that the user may access through the website, mainly through the search engine or within the space reserved for registered users, are the property of Textilfy or its legitimate owners (see clarification in point 3). Such information may be viewed for personal, informational, and non-commercial uses. But it is forbidden to copy, distribute, perform, reproduce, license, transfer or sell any type of information that is extracted from the Textilfy website.

Textilfy makes specific changes to the information, inserting watermarks with encryption technology, which do not alter the content or meaning of the same to any degree, but which allow the detection of illicit commercializations in its database and the origin of such commercializations, as well as the date and IP of extraction. Textilfy will be able to prove the illicit capture of information and, therefore, will demand the penalties typified in the penal code regarding the misappropriation of databases.

3. COPYRIGHTS AND TRADEMARKS.

The intellectual and industrial property, trademarks, graphics, images, logos, information and icons visible on the Textilfy Website are the exclusive property of Círculo Textil Servicios Textiles SL or, where appropriate, of the entity, company, individual or group that has authorised their inclusion. All content and its format are protected by applicable national laws.

The interested use of any content found on the Textilfy Website is absolutely prohibited, unless there is a written license granted.

All images, photographs and designs uploaded by registered users maintain the rights of their legitimate authors and do not become the property of Textilfy.

4. PRIVACY POLICY.

The objective of Textilfy’s privacy policy is to comply as much as possible with current legislation on the protection of personal data. Textilfy will not use your information without your permission other than your email address, when required, to have a conversation that is initiated by you, and to provide you, as far as possible and without being obligated at any time, with a way in which you can manage your own information and services. By using the Textilfy Website, you are authorising us to store the trace left by your IP address for the purpose of administering the systems, improving the effectiveness of the Website and carrying out global statistical studies, as well as security measures and to respond to legal requests if necessary. The user has the possibility of accepting or rejecting cookies by configuring their browser for this purpose. In this case, some of the functionalities of the website may not work properly. Sometimes, in the forms in which data is collected, authorization is requested to send you news about the Textilfy service and/or third parties, and occasionally Textilfy carries out surveys to know the User’s level of satisfaction with the service.

Textilfy, in its capacity as owner and manager of the Website, may not sell or rent its list of Users and contact details to third parties, although it is possible that within the communications it makes directly, information from third parties that Textilfy understands to be of special interest to the User may be incorporated, being able to oppose this processing at any time as stated in our privacy policy.

5. LIABILITY.

Textilfy is not responsible for damages that may occur due to failures or misconfigurations of the software installed on the User’s computer, transmission failures and defects of the software manufacturer. This website is prepared by default to be viewed in Internet Explorer 7 onwards, Firefox 3 onwards, Google Chrome 5 onwards and in general browsers that comply with web standards and for any operating system. Textilfy is not responsible for the lack of display of relevant information that may occur in another type of possible combination of browsers and/or operating systems.

You are solely responsible for what happens on your own Computer, and you must take appropriate security measures to protect the information hosted on your Computer, to prevent loss or damage caused by downloads from the Website with respect to the information that the user may access through the Website, due to the different sources of obtaining it and its recording process, Textilfy does not guarantee the absolute correctness of the same and therefore the User cannot demand any liability for damages derived from errors in the information provided.

6. MODIFICATIONS.

Textilfy may vary these conditions at any time, although it is not intended to be frequent, by publishing the dates of the modifications on this page and taking effect immediately. If a part of these terms and conditions is no longer applicable due to a legislative change or court decision, these clauses will be annulled, but the others will be perfectly valid and will remain in force. By continuing to use our website, you agree to these terms and conditions and agree to accept any modifications made to them, and you agree to check this page frequently. If you do not accept these conditions, you should not continue to visit the Textilfy Website.

The contents of Textilfy do not have any political line nor is any ideology or political-social or business group supported above another.

GENERAL TERMS AND CONDITIONS OF SALE FOR STOCK FABRIC PRINTING ON TEXTILFY

1. THE FABRIC

– Although we strive to maintain a standard of quality in our fabrics, we cannot avoid characteristics such as touch, background color, weight, shrinkage… etc. may vary slightly between remittances, so we ask our customers for some flexibility in this regard.

– Likewise, the widths between pieces can vary a few centimeters, so the printed width of each fabric is indicative.

– All fabrics shrink and some can also be enlarged in the printing, finishing and washing and drying processes. Because Textilfy is not a fabric manufacturer but a printer, complaints about shrinkage or distortion of images will not be accepted, which, as a rule, should not exceed 8%. For more information on this topic, please consult us directly.

– We strive to have high quality and wide variety fabrics but there are problems inherent to each fabric that we cannot avoid, for example, synthetic fabrics tend to peel, the circular point may have tasting holes in the middle of the piece (which will never be taken for granted), cellulosic fabrics may have lees, etc. We ask our customers to familiarize themselves with our fabrics before placing large orders, as we will not be able to respond to problems of this type that it is not in our power to solve, although we will always seek to minimize these problems and be cooperative in their solutions.

– All Textilfy fabrics are printed on the side that looks best. If the client wanted to print their fabric on the “wrong side” they would have to consult with our staff first and, if possible, make a written request observing this requirement.

– If the customer orders several drawings/colors in the same order of the same genre, the prints do not have to be delivered in order, and can be delivered in a single piece. If the customer wants a specific order or exploded delivery, they must request it first and this work may have an associated design cost.

– During the stamping of an order, it is normal for there to be cuts in the printing due to machine stoppages or defects in the product or part changes. In these cases, at Textilfy we carry out 50 centimetres more printing for each machine stop if what is printed is a rapport, or, if it is a panot, we repeat the cut pieces.

– As a general rule, orders of less than 6 meters are delivered folded and of more than 6 meters of the same kind are delivered wound. If the client wishes a change in this rule, he must request it prior to these conditions and this will be quoted.

– Right thread: we strive to achieve the best results for each customer, however, due to the weave shape of each item, and the stamping shape of the digital stamping machinery, it may happen that the right thread is not fully parallel to the vertical axis of the drawing. If this happens, the customer agrees to accept the results of the stamping, provided that the variation with respect to said axis does not exceed 15 degrees in areas of 20 linear cm or less. Our semi-silk, voile and, in general, the finest fabrics deserve special mention.

2. THE STAMPING PROCESS

– QUALITY OF THE IMAGE REPRODUCED: THE IMAGES PROVIDED BY THE CLIENT WILL BE REPRODUCED WITHOUT ANY CHANGE BY TEXTILFY. ANY CHANGES WILL BE BUDGETED AND ACCEPTED PRIOR TO THEIR EXECUTION. Textilfy will only be responsible for image errors (rapport failure, mode, icc, size, layout, etc.) if the customer PAYS FOR IMAGE CHECK at the time the order is placed.

– Playback failures caused by file problems such as incorrect sizes, color change due to the use of alpha channels… in no case will they be the responsibility of TEXTILFY, unless the client has previously notified of this situation and always via email.

– In digital printing on natural fabrics, the outermost part of the fabric, around 8 cm closest to both selvedges, the prints could look somewhat out of focus or with double lines, this effect will be especially noticeable in designs with fine lines and a lot of detail. It is something that cannot be completely avoided and although our team will always try to minimize these effects as much as possible, we must bear in mind that they can occur to a greater or lesser extent. The customer must avoid this type of design in the areas near the selvedges since returns or repetitions of this type of incident will not be accepted.

– The fabric is not a smooth canvas like paper and therefore the quality of the image reproduced can be very different from that of a reproduction on paper. The factors on which this depends are on the one hand the quality/format/size of the image and on the other hand the fabric chosen.

– In general, lines of less than 1 mm. will not have a good quality of reproduction.

TEXTILFY WILL NEVER ACCEPT A RETURN BECAUSE THE QUALITY OF THE IMAGE REPRODUCED IS NOT AS EXPECTED, UNLESS IT IS A MACHINE DEFECT (BANDING, STAINS, RUNNING INK…). For this reason, we recommend our clients to place a test order with their images before making a production.

– Orders of more than 8 meters will generally be cut into cloths of a maximum of 8 meters. In case you need longer uncut cloths, contact us.

– Small and sporadic stains, which can occur in certain types of printed fabric. This is due to the raised fibers of these fabrics that rub against the printing heads or create a “screen” leaving small specks of the fabric’s background color, and no complaints are allowed against them.

– In synthetic fabrics, a “halo” effect can occur, especially in more contrasting prints, with strong colors on white or light backgrounds. It is inevitable and, therefore, complaints about it will not be accepted.

– The selvagis of the fabric (1 to 10 cm. margin on each side of the fabric that you will generally receive UNPRINTED) can suffer small rubbing, fittings, etc., which can lead to stains or holes. As long as these are within the boundaries of the selvedges, the stamping will not be accepted as defective.

– The stamping may not follow a perfect straight line parallel to the selvage. We print fabric and in both the direct printing and sublimation processes it is practically impossible to keep the fabric completely straight. There may be variations of 5cm between one margin and another.

– Any other defect or defect that occurs during the printing or finishing of the fabric and is detected by our operators, will be solved with the printing of 50 cm more for each damaged area if it is a rapport, or the panot damaged in its entirety (if it is panots or positional).

3. THE COLOR

COLORS: THE COLOR RESULTS OF A PRINT DEPEND ON THE FIBER ON WHICH THEY ARE PRINTED. IN NO CASE WILL WHAT THE CUSTOMER “SEES ON THE SCREEN” SERVE AS A REFERENCE FOR THE COLOR OF THE FABRIC. TO ENSURE THE COLOUR IT IS NECESSARY TO WORK WITH TEXTILFY COLOUR CHARTS SPECIFIC TO EACH FABRIC, FOLLOWING ITS INSTRUCTIONS AND WITH A CMYK COATED FOGRA39 PROFILE.

OR, IF THAT IS IMPOSSIBLE, TO PERFORM COLOR TESTS OR IMAGING STUDIES.

– Even if you work with Textilfy color charts and follow all the instructions that accompany them, or make previous color samples, the color results may vary. This is because small changes in temperature, humidity, fabric, ink composition, etc., can directly affect color results.

– In the sample catalogue you can get an idea of the result of the CMYK. The blue, magenta, black and yellow in the print correspond to pure colors. In any case, Textilfy will be happy to print a color chart with more than 2000 colors on any fabric, even the one provided by the customer, at a fixed cost. So that the customer can color their images and achieve an exact color performance as desired. The final color of the prints has an accepted variance with respect to the color of the pants of a maximum of +/-10% due to the different temperature and humidity conditions that may exist in the finish. If the customer is not satisfied with the color, Textilfy will follow the following procedure, only in case the customer has worked with specific color charts from Textilfy (in other cases the color suitability cannot be checked):

a. Ask the customer to identify the colour in their colour chart printed by the company, which must be made on the same fabric and during the previous 6 months at the latest.

b. On one of the company’s computers, this colour will be clicked on the Textilfy digital colour chart and on the customer’s image in the image program that corresponds to them according to the instructions.

– The “background color” of our fabrics is white or ecru (depending on the fabric), and if the client wants to print a background of another color they must include it in their file. Likewise, if the client paints an area of white in their file, this area will be the “background color” of the fabric.

4. USE OF PRINTED FABRIC

– In finished fabrics, so that the color is preserved as best as possible in the wash, it is advisable to wash the garment inside out in short washing machine programs at 30 ºC, without pre-washing, and with phosphate-free soap for colored clothes (for more information talk to Textilfy). Never dry clean and, if hand washed, use only the recommended amount of detergent and do not soak more than indicated. Do not tumble dry and allow to air dry.

– Not all fabrics are equally resistant to wear and tear due to washing or friction, so, as a general rule, we do not recommend industrial washes, dry cleaning or hand washing with a lot of soap/friction. In any case, if you need a fabric whose print is very resistant to wear, please write us an e-mail to hello@textilfy.com telling us your case and we will recommend the one that best suits your needs. Never accept these conditions without first being sure if the fabric you are going to print on meets the washing expectations you have.

– Specifically, it is good to know that in prints on cellulose or protein fibers (silk, cotton, linen, viscose…), when a solid background color is made, or the print has a lot of background and little shape (the solid color is very visible), partial wear can occur in the wash. We do not recommend solid background colors.

– It is recommended to iron the prints on the back and with the iron on medium heat. Our synthetic fabrics do not allow pleating and must be ironed carefully by placing a cloth between the printed sides of the fabric if they are to be ironed against each other, always doing a prior ironing test.

– As for the uses of the fabric, it is up to the customer to carry out the necessary tests to verify that the fabric meets the needs required for the desired application, since we are not responsible for possible damage caused by its use.

– TEXTILFY also recommends carrying out wear tests before making a product and even making a prototype and using it for several months before launching final production in order to avoid future claims.

5. PRODUCTION TIMES

– Delivery times are indicative. We try to print the synthetic fabric in 5-7 working days from the day after the order is placed. In natural fabrics our production times are around 10-12 working days.

– Delivery times for ready-made products will be approximately 2-3 weeks, this time will depend on the volume of the workshop at the time of purchase, we recommend asking in each case to have more specific information.

– In the shopping cart you can choose several shipping options and these indicate an ESTIMATE in the delivery period.

– Returns will not be accepted for orders that have not been delivered within the ESTIMATED delivery time, unless more than 30 working days have passed.

– There are periods of high production in the factory. Occasionally throughout the year there may be periods (usually weeks) in which production periods cannot be strictly complied with. We ask the customer to be flexible in these cases and understand the problems that come with producing at certain times of the year when many customers want their orders on the same dates.

– We always ship within 24 hours. Therefore, once the order is in the Shipped status, there is a high probability that the customer will receive it the next day.

6. LEATHERETTES

Faux leather is a special “fabric” because it is not really woven, it is made by spreading a layer of PVC on a woven backing. Then it is textured to finish it imitating natural skin.

– The leatherette manufacturer does not guarantee that the woven support on which the leatherette is manufactured is always exactly the same. There can be variations in tone, from an optical white to a crude one. The thickness and texture of the support (the back of the leatherette) can also vary.

– TEXTILFY places large orders for leatherettes, buying them for complete productions on pallets. The supplier does not undertake that the leatherette from one batch to another will be identical. There may be differences in tone, texture and feel, being even more or less elastic than in previous games.

– Printed leatherette is not an indestructible product. When making products such as bags or toiletry bags, where the corners suffer especially from rubbing, TEXTILFY recommends that those corners be protected with dyed (non-printed) leatherette.

– TEXTILFY also recommends carrying out wear tests before making a product and even making a prototype and using it for several months before launching final production in order to avoid future claims.

– It cannot be washed in the washing machine although some customers have tried it and it works correctly, always at their own risk.

– Under no circumstances will TEXTILFY be responsible for the replacement cost of products made with leatherette even if it is defective. The defective meters will only be replaced after receiving them all at the factory and checking the production equipment that they do not have the appropriate resistance to wear.

Shipping prices are constantly changing due to the current global transportation situation. These are updated directly on the website and may be modified without prior notice.

General conditions of sale for printing on fabrics provided by the customer on TEXTILFY

Fabrics provided by the customer must obey these rules:

  1. Measure less than 160 cm wide.
  2. Be edged on both edges.
  3. The exact fabric composition must be supplied by the customer.
  4. They must be chemical or optical white.
  5. An extra 1 meter per piece is needed for machine entry into production.
  6. They should have no wrinkles, holes, cuts. And they must be in the same line.
  7. The fabric must be delivered in a cardboard tube, whose diameter must be between 5.5 and 6 cm.
  8. For orders of less than 30 meters the fabric must come in one piece (without cuts), and should never exceed 25-26 cm in total diameter.
  9. If the customer does not specify the top and back of the fabric, Textilfy will decide on which of the two sides it will print.

If the customer’s fabric is damaged in the printing process, the only responsibility that Textilfy acquires is not to charge the customer for the service and, if the customer wishes and delivers more fabric, to perform the service again (or to try it) at the same cost, always within a time limit of less than 30 days and as long as the conditions allow it. This means that the client will never be compensated in any way because their tissue has been damaged.

If the customer’s fabric has hairs/lint/lint or any other material that may cause a screen effect, the customer will assume the results of the printing. The fabric cannot be brushed unless it is made of polyester.

– All fabrics shrink and some can also be enlarged in the printing, finishing and washing and drying processes. Because Textilfy is not a fabric manufacturer but a printer, complaints about shrinkage or distortion of images will not be accepted, which, as a rule, should not exceed 8%. LEGAL CONDITIONS

BY ACCEPTING THIS DOCUMENT, THE CLIENT DECLARES THAT HE OR SHE POSSESSES ALL THE RIGHTS NECESSARY FOR THE REPRODUCTION OF THE IMAGES THAT HAVE BEEN DELIVERED OR WILL BE DELIVERED FOR PRINTING ACCORDING TO THE BUDGET TO WHICH THIS DOCUMENT IS ATTACHED.

– Textilfy retains ownership of the goods until full payment of their amount, including taxes. In the event of non-payment on the day of its maturity, the sale will be frozen with full right and for the benefit of Textilfy, by simple communication, without further formalities or prior notices and with the reservation of the legal actions that, for damages, Textilfy may bring against the debtor or debtors.

– Textilfy reserves the right to increase deadlines or cancel orders in progress in cases of force majeure (machinery breakdown, lack of water, energy, irregularities in the supply of raw materials, strikes, etc.).

– In the event of delays in dispatch, the customer has the right, except for reasons of force majeure or agreements to the contrary, to cancel their order, after 40 days of the scheduled or agreed consignment date.

– Any complaint about the quality of the goods must be communicated within a maximum period of 8 days from the date of delivery of the same. The customer will lose this right in case he has modified the original consistency of the goods or has simply used them.

– Any return will be accepted only when it has been authorised by the sales managers and provided that the supplier’s right to control the goods once they have arrived at their warehouses is preserved.

– The parties choose the courts of Madrid for all disputes and controversies that may arise in litigation. Acceptance of these conditions implies the acceptance by the customer that Textilfy may mention the customer’s name or brand within the “our customers” and similar sections. If the customer does not wish to allow the use of their name, they must write to us at hello@textilfy.com to indicate how to proceed.

In compliance with the provisions of the L.O. 15/1999 on the Protection of Personal Data, we inform you that your data has been incorporated into the files of Círculo Textil Servicios Textiles SL. If you do not wish to receive communications from Textilfy you must write to us at hello@textilfy.com to tell you how to proceed.

Returns

We are sure that your satisfaction will be maximum when you receive one of our products at home. We have cutting-edge technology in direct printing on rigid and flexible materials. Even so, if the product you have received does not convince you 100% because it has a defect greater than 5mm in the printing or fabric, you can return it within 7 days. Normally we spend 3 working days on producing. To this time you must add the shipping time according to the shipping option you have chosen.

To ship it back to our facility, you must pack it perfectly to ensure that it is not damaged during transport. We will replace the fabric assuming the shipping costs. The address you should send the fabric to is as follows:
